Rule 77
Family allowance or pension
(1) If a police officer dies while in service or within seven years of receiving pension, his family or his minor brother or unmarried sister will receive gratuity or pension as written in rule 74 or 75. But in case of pension, such pension will not be received for more than seven years. Family members, minor brothers or unmarried sisters of police personnel who died before seven years of starting pension will not receive pension after seven years.
(2) Notwithstanding anything written in sub-rule (1), if the person receiving pension is a minor, he shall receive such pension until he attains the age of eighteen years.
(3) If the widowed husband or widowed wife of a police officer dies within seven years of his or her spouse being in service or within seven years of the commencement of pension, he or she shall be entitled to a family pension as per sub-rule (1), from the date of payment of such pension and if he or she does not receive such pension or his or her husband or If the wife dies after seven years have passed since she started receiving the pension, she will get half of the amount of the pension she would have received from the date of her death.
(4) When there is an increase in the salary of the existing police personnel of the same position, two-thirds of the increase in the starting salary will be added to the family pension. However, if the police personnel of the same rank are not in service, two-thirds of the increase in the salary of the police personnel of the same rank of the Nepal Police will be added to the family pension.
(5) If a police officer dies without being able to receive any amount due under this rule, the person who is determined to receive his gratuity or pension according to this rule among the members of his family will be entitled to receive that amount.
(6) When giving a gratuity or pension, if the deceased police officer has a minor brother or an unmarried sister among his family members, and if for some reason the person is unable to receive the gratuity or pension or if he does not wish anyone, then the government of Nepal among the family members of that police officer It will be given to the appropriate person.
